1. Agreement to Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Sheldon Health Pty Ltd (ABN XX XXX XXX XXX) ("Sheldon Health", "we", "us", or "our") governing your access to and use of the Sheldon Health platform, including our website, mobile applications, and related services (collectively, the "Platform").
By creating an account or using our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our services.
2. Service Description
Sheldon Health provides a digital platform for ADHD (Attention Deficit Hyperactivity Disorder) assessment, management, and care coordination, including:
- Validated ADHD screening and assessment questionnaires
- Connection to registered healthcare practitioners
- Telehealth appointment scheduling and video consultations
- Health record management and care plan tracking
- Educational resources and support materials
3. Important Medical Disclaimer
THE SHELDON HEALTH PLATFORM IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.
- Our self-assessment tools provide indicative results only and do not constitute a medical diagnosis
- All diagnostic decisions are made by qualified, registered healthcare practitioners
- Always seek the advice of your physician or qualified health provider with any questions regarding a medical condition
- Never disregard professional medical advice or delay seeking it because of something you have read on our Platform
- If you are experiencing a mental health crisis, please contact emergency services (000) or Lifeline (13 11 14) immediately
4. User Eligibility and Accounts
4.1 Eligibility
You must be at least 18 years old to create an account independently. Users under 18 may access the Platform with verified parental or guardian consent.
4.2 Account Responsibilities
- Provide accurate, current, and complete information during registration
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
- Not share your account with others or create multiple accounts
5. Subscription Plans and Payments
5.1 Plan Types
- Public (Free): Basic ADHD questionnaire and indicative assessment
- Members ($9.67/month or $96.70/year): Full assessment suite, practitioner access, appointments, and ongoing management
- Practitioners (Free): For registered healthcare professionals to manage patients
5.2 Billing and Cancellation
- Subscriptions are billed in advance on a monthly or annual basis
- Payments are processed securely via Stripe
- You may cancel your subscription at any time; access continues until the end of the billing period
- Refunds are provided on a case-by-case basis in accordance with Australian Consumer Law
- We reserve the right to modify pricing with 30 days' notice
6. Practitioner Services
Healthcare practitioners on our Platform are independent professionals, not employees of Sheldon Health. While we verify practitioner credentials, including AHPRA registration, we do not guarantee the quality, accuracy, or outcomes of their services.
- Appointment fees are set by individual practitioners and are separate from Platform subscription fees
- Cancellation policies are determined by each practitioner
- Medicare rebates may be available depending on practitioner and service type
7. User Conduct
You agree not to:
- Use the Platform for any unlawful purpose
- Provide false or misleading information
- Attempt to gain unauthorized access to any part of the Platform
- Interfere with or disrupt Platform operations
- Impersonate another person or entity
- Use automated systems to access the Platform without permission
- Harass, abuse, or harm other users or practitioners
8. Intellectual Property
All content, features, and functionality of the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of Sheldon Health or its licensors and are protected by Australian and international copyright, trademark, and other intellectual property laws.
9. Limitation of Liability
To the maximum extent permitted by Australian law:
- Sheldon Health provides the Platform on an "as is" and "as available" basis
- We make no warranties regarding the accuracy, reliability, or completeness of any content
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
- Nothing in these Terms excludes or limits liability that cannot be excluded under Australian Consumer Law
10. Indemnification
You agree to indemnify, defend, and hold harmless Sheldon Health, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any rights of another party.
11. Termination
We may suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, practitioners, us, or third parties, or for any other reason.
Upon termination, your right to use the Platform will immediately cease. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
12. Governing Law and Disputes
These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms or your use of the Platform shall be resolved through mediation before pursuing legal action. If mediation is unsuccessful, disputes shall be resolved in the courts of Victoria, Australia.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Platform at least 14 days before they take effect. Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.

15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
